Family Law Representation
Family law representation is the art of representing the client involving what is the client’s most intimate and personal area of life: the client’s family. These types of cases include divorce, child custody, child support, and adoptions.
Because the cases in this area of law involve the client’s family, the parties are frequently emotional. Unlike most other types of litigation which tend to focus on past events, like criminal or personal injury cases, family cases are typically “in progress” and can be very chaotic and stressful. Family law is relatively black letter but what complicates the process is the personalities of the litigants, the attorneys representing them, and even the judge that presides over the case.
Good family lawyers are good at managing conflict and managing personalities. They focus on getting their client to focus on what is important in the litigation rather than focus on righting past wrongs that occurred in the relationship.
Many litigants choose to represent themselves in court. This is often inadvisable. By law, you are held to the same standard as a practicing attorney. If you do not know the appropriate law or how caselaw has interpreted the law, you will be stuck with the consequences. As mentioned above, emotions can cloud judgment and your lawyer is someone that should be able to provide an objective point of view to your situation. Judges also tend to prefer to deal with parties represented by attorneys because the attorneys should be familiar with the court rules and allow for a more efficient use of the court’s time. Your attorney will also be able more efficiently, effectively and persuasively present evidence on your behalf.
